Legal Risks
Businesses face legal risks all the time, and in many cases are not aware of the extent of those risks. Examples include:
-
Credit Risks: the risk that one or more significant customers may not pay their invoices.
Action: Ensure you have valid retention of title clauses in your contracts. Join credit circles. Take action against debtors sooner rather than later.
-
Management Risks: is the management knowledge of your company concentrated in the hands of too few people and what happens if something happens to them?
Action: delegate where appropriate. Consider the risks of accident to senior management at all times.
-
Shareholder Dissatisfaction: is the Company at risk because some shareholders are "disaffected"?
Action: remember that they have a genuine interest in the Company as shareholders. They may have rights to be consulted or receive income, or if the problems are brewing, should they be removed?
-
Contractual Risk: has the company entered a contract where it is bound to deliver something outwith its control? Can that risk be laid off?
Action: after getting the order and before signing off the paperwork, check whether you can deliver what you have agreed to deliver. If there is a risk, can anything be done about it?
